TERMS & CONDITIONS OF THE ONLINE STORE

These Terms & Conditions set out the rules for making purchases in the online store operated by the Seller at: http://www.pureforbrides.pl.

§ 1 Definitions

Terms & Conditions – these Terms & Conditions. With respect to services provided electronically, these Terms & Conditions constitute the rules referred to in Article 8 of the Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws 2002 No. 144, item 1204, as amended).

Customer – a natural person, a legal person, or an organisational unit without legal personality but having legal capacity, who places an Order in the Online Store under these Terms & Conditions.

Consumer – a Customer who is a natural person using the Online Store for purposes not directly related to their business or professional activity.

Service Provider – the entity providing sales services via the Online Store under these Terms & Conditions.

Subject of the transaction – Goods listed and described on the Online Store website.

Goods / Product – a movable item presented in the Online Store and covered by the Sales Contract.

Additional service – a service provided by the Service Provider to the Customer outside the Online Store in connection with the nature of the Goods sold.

Sales Contract – a contract for the sale of Goods within the meaning of the Polish Civil Code, concluded between the Service Provider and the Customer using the Online Store website.

Online Store (Store) – the online service available at the Store’s website address through which the Customer may place an Order.

Order – the Customer’s declaration of intent specifying the type and quantity of Goods, directly aimed at concluding a Sales Contract.

ICT system – a set of cooperating IT devices and software enabling processing and storage, as well as sending and receiving data via telecommunications networks using an appropriate end device for a given network type.

§ 2 General Provisions

  1. These Terms & Conditions define the rules for using the online store available at: http://www.pureforbrides.pl.

  2. Placing an Order in the Online Store requires the Customer to read and accept these Terms & Conditions during the Order process.

  3. The PURE online store conducts retail sales via the Internet and stationary (in-person) sales via the ARTTREND showroom in Gdańsk at ul. Sienkiewicza 1/1.

  4. All Goods offered in the PURE store are brand new, handmade, free from physical and legal defects, and have been legally introduced to the Polish market.

  5. To use the ICT system used by the Service Provider to complete purchases, the Customer must have an active e-mail account and a device with Internet access.

  6. The Customer is obliged not to provide content prohibited by law, e.g. content promoting violence, defamatory content, or content infringing personal rights and other rights of third parties.

§ 3 Placing Orders

  1. All prices shown on the website are gross prices (including taxes) stated in Polish zloty (PLN). Prices do not include shipping costs.

  2. Orders are accepted via the website / by e-mail / via social media.

  3. Orders placed via the website can be submitted 24 hours a day, 7 days a week, all year round.

  4. An Order is effective if the Customer correctly completes the order form and provides accurate contact details, including the exact delivery address, phone number, and e-mail address.

  5. If the provided data is incomplete, the Seller will contact the Customer. If contact is not possible, the Seller has the right to cancel the Order.

  6. During the ordering process, the Customer may request a receipt, which may be enclosed with the parcel or sent electronically to the indicated e-mail address as a PDF file. This consent also authorises the Seller to issue and send receipts/invoices electronically in accordance with the relevant regulations of the Minister of Finance regarding electronic invoices.

  7. During the ordering process, the Customer may consent to their personal data being stored in the Seller’s Online Store database for processing in connection with Order fulfilment. If consent is granted, the Customer has the right to access, correct, and request deletion of their data.

  8. The Customer may choose to save their data in the system to facilitate placing future Orders. For this purpose, the Customer must provide a login and password required to access the account. The login is the Customer’s e-mail address. The password is set by the Customer, is not known to the Seller, and the Customer is obliged to keep it confidential and protect it against unauthorised access.

  9. After placing an effective Order, the Customer will receive an automatic confirmation from the store acknowledging receipt of the Order.

  10. The Order fulfilment period starts when:

  • the payment is credited to the bank account indicated in the order confirmation (bank transfer), or

  • the Order is placed (card payment).

§ 4 Shipping Costs and Delivery Time

  1. Goods are shipped to the address provided in the order form or provided by phone or e-mail. The Store will promptly inform the Customer if the order form has been completed incorrectly, which prevents shipment or may delay it.

  2. Goods are delivered via courier companies: InPost Sp. z o.o. and DPD.

  3. The parcel is delivered within the time indicated for each Product on the website. This is an estimated delivery time. When the “PayU” option is selected, fulfilment is carried out within the timeframe indicated for each Product from the moment the Store receives confirmation of payment.

  4. The Customer is charged the delivery (shipping) costs as specified in the shipping price list.

§ 5 Payments

  1. A fiscal receipt is issued for each sold Product and is included with the parcel. An invoice may be issued upon prior contact.

  2. Payment for the ordered Goods can be made via the PayU electronic payment system, by payment card, or in cash upon personal collection.

  3. Cards supported by the system: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.

  4. If it is necessary to refund a transaction made by card, the Seller will refund the amount to the bank account assigned to the Customer’s payment card.

§ 6 Complaints and Returns

A. Complaints

  1. Complaints may be submitted to:

  2. To facilitate identification of the Customer and the reported issue/claim, it is recommended that the complaint includes:
    a) Customer details enabling contact and identification, including e-mail address and phone number,
    b) the type of Product to which the complaint relates,
    c) the Customer’s allegations/claims,
    d) circumstances justifying the complaint,
    e) optionally, the Customer’s preferred method of resolving the complaint or remedying the alleged breach.

  3. The complaint should be submitted within 2 months from the date on which the complainant discovered the circumstances constituting the basis for the complaint.

  4. The PURE store undertakes to respond to the complaint within 14 days of receipt.

B. Returns (Withdrawal from the Contract)

  1. In accordance with the Act of 30 May 2014 on Consumer Rights, within fourteen (14) days of receiving the ordered Goods, a Customer who is a Consumer has the right to withdraw from the distance contract and return the Goods without stating reasons and without incurring costs, subject to the provisions of Article 33, Article 34(2) and Article 35 of the Act on Consumer Rights.

  2. The right of return does not apply to non-prefabricated Goods manufactured according to the Customer’s specification or serving to meet the Customer’s individual needs.

  3. Returned Goods must not show signs of use and must be delivered in an intact condition, i.e. in the same condition in which they were delivered to the Customer.

  4. If the Goods are returned in accordance with these Terms & Conditions, the PURE store will refund the purchase price within 10 business days to the bank account indicated by the Customer.

  5. Return information is available at http://www.pureforbrides.pl on each Product page.

§ 7 Amendments to the Terms & Conditions

  1. Customers who have an account in the Store will be informed about amendments to the Terms & Conditions by e-mail.

  2. If the Terms & Conditions have changed since the Customer’s last login, the Customer must accept or reject the amended Terms & Conditions. If the amended Terms & Conditions are not accepted, shopping in the Online Store is not possible.

  3. A Customer who does not accept amendments has the right to delete their account at any time.

  4. Orders placed before the amendments enter into force will be fulfilled under the previous version of the Terms & Conditions.

§ 8 Final Provisions

  1. In matters not regulated by these Terms & Conditions, the provisions of Polish law shall apply, in particular:

    • the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product,

    • the Act of 27 July 2002 on specific terms of consumer sales and amendments to the Civil Code,

    • the Act of 23 April 1964 – the Polish Civil Code.

  2. Disputes arising from the application of these Terms & Conditions and in connection with the performance of contracts concluded between the Store and Customers shall be examined by a competent court pursuant to the rules of subject-matter and territorial jurisdiction, in accordance with the Act of 17 November 1964 – the Polish Code of Civil Procedure.

RETURNS

 

Slight differences in shape, size, and color are possible. However, we always strive to ensure that the ordered product is made as closely as possible to the sample photo.

Non-prefabricated goods, those made to order or designed to meet the Buyer's individual needs, are not eligible for return. Returned goods must not show any signs of use. They must be delivered in undamaged condition, meaning the same condition in which they were delivered to the customer within 14 days of receipt.

Handmade products made to order are non-returnable.

SHIPPING AND DELIVERY

Orders are shipped via DPD courier and InPost parcel lockers. Shipping costs are as follows:

InPost parcel locker - PLN 15

We offer free delivery on orders over 500 PLN.

Delivery time is 1-3 business days.

We also offer personal collection of your order at the ARTTREND showroom, ul. Sienkiewicza 1/1, 80-277 Gdańsk.

Possible forms of payment upon personal collection: prepayment, cash or card payment in the salon.
